By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.

Description of Services

Boost My Biz develops and operates enterprise software platforms and related tools for organizations managing confidential information, complex workflows, and business operations. Services may include web-based applications, reporting tools, integrations with third-party platforms, and related support or professional services as made available from time to time.

We may modify, suspend, or discontinue any aspect of our services at any time, with or without notice, subject to applicable agreements with customers or users.

User Responsibilities

Third-Party Services and Integrations

Our services may integrate with or depend on third-party platforms, APIs, and services. Boost My Biz is not responsible for third-party services and does not control their availability, functionality, or policies.

Google and Google Ads Integrations

Certain Boost My Biz software tools, including TowMe Ads Intelligence, may allow authorized users to connect Google accounts through OAuth to access Google Ads or related Google services for legitimate business functions such as campaign performance analysis, advertising reporting, search and query performance analysis, keyword and campaign intelligence, account diagnostics, and internal decision support.

By authorizing a Google integration, you acknowledge that:

Boost My Biz's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Intellectual Property

Our website, software, content, branding, and related materials are owned by Boost My Biz or our licensors and are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from our materials without prior written consent.

You retain ownership of content you submit to us, subject to any rights necessary for us to operate and provide our services.

Confidentiality

Where our services involve access to confidential business information, users agree to use such information only for authorized purposes and to protect it in accordance with applicable agreements and reasonable security practices. Confidentiality obligations may also be governed by separate written agreements between Boost My Biz and its customers.

Availability and Changes to Services

We strive to provide reliable services but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or changes that temporarily affect availability. We reserve the right to modify features, functionality, or these Terms at any time as described herein.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that our services will meet your requirements, operate without interruption, or be free from errors or harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, Boost My Biz and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of or inability to use our website or services.

To the extent permitted by law, our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid to Boost My Biz for the specific service giving rise to the claim during the twelve (12) months preceding the event, or one hundred Canadian dollars (CAD $100) if no such fees were paid.

Indemnification

You agree to indemnify, defend, and hold harmless Boost My Biz and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any third-party rights or applicable law.

Termination

We may suspend or terminate your access to our website or services at any time if we reasonably believe you have violated these Terms or if necessary to protect our systems or users. You may stop using our services at any time. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification provisions.

Separate Agreements

Certain services may be subject to additional written agreements, order forms, statements of work, subscription agreements, data processing agreements, or other terms between you and Boost My Biz. If these Terms conflict with a separately executed written agreement governing a particular service, the separately executed agreement will control with respect to that service.

Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that the courts located in Alberta, Canada will have exclusive jurisdiction over disputes arising out of or relating to these Terms, subject to applicable law.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by applicable law.
